Contracting for Data Security: Protecting Against Emerging Threats

Numerous suppliers have copies of your data or access to your systems. Few to no suppliers promise absolute data security or indemnify you for the full harm you suffer from a data security breach. As a result, you are subject to both business and legal risk from supplier data security breaches. This session will provide a framework for how to identify, mitigate and manage these critical risks in supplier contracting. The framework is based on screening in the selection phase, securing the key contractual protections and incentives in the sourcing phase and following up through an integrated security plan in the governance phase.
